Terms and Conditions

Please find below our Terms and Conditions, which formthe basis of the contract between you (the client) and Dovey Cake Design. Any breach of these conditions will constitute a breach of contract and may terminate the contract with no redress on or liability for Dovey Cake Design. These terms and conditions do not affect your statutory rights. 

Payments made to Dovey Cake Design are deemed by Dovey Cake Design as acceptance of these terms. 

1. Basis of Sale

These Terms and the Confirmation of Order are considered by Dovey Cake Design to set out the whole agreement between Dovey Cake Design and the client for the sale of wedding cakes.

 

Please check all details in the Confirmation of Order are complete and accurate prior to supplying written approval.

 

Any quotations are valid for a period of 30 calendar days from the date of. Issue. Dovey Cake Design reserves the right to make changes to any quotations not approved in writing within this time period.

 

The client may amend or cancel an order up to 28 days prior to the due delivery/collection date, by providing written notice.

In the case of alterations to an agreed cake design, a new Confirmation of Order will be issued, detailing the amendments and revised cost. Alterations are not confirmed until a new Confirmation of Order has been issued.

2. Cancellations

In the event of a cancellation by the client, any payments previously made are non-refundable.

 

Cancellations by the client will incur the following charges:

90 days notice or more - booking fee only 

Between 90 days and four weeks - 50% of the full price

Less than four weeks’ notice: 100% of the full price

In the unlikely event that Dovey Cake Design needs to cancel an order, any deposits paid will be fully refunded to you. No further liability will be sought.

 

Possible reasons for cancellation include but are not limited to; death, injury, illness (due to health and safety regulations), serious medical condition or accident to Clare Dovey-Wilson or family member. In the event of cancelling an order, Dovey Cake Design will take all necessary steps to place the cake with an alternative and similarly high-quality cake designer, trusted by Clare Dovey-Wilson.

3. Service provision

We warrant that on delivery or collection the cakes shall conform to their description as set out in the Confirmation of Order, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK.

Dovey Cake Design will not be held responsible or face subsequent liability for client disappointment at any design or interpretation, as long as it is made in line with the client’s agreed requirements as set out in the Confirmation of Order.

 

Dovey Cake Design will not be held responsible for any defect in the cakes arising from wilful damage, accident, and negligence by the client or any third party. This applies if the client displays or treats the cake in a way not recommended by Dovey Cake Design, failure to follow our care instructions or any alterations the client may carry out.

 

Where colour swatches are provided by the client for reference, Dovey Cake Design will endeavour to create a match as close as possible. Exact colour matches are not guaranteed.

 

From time to time certain materials and supplies used to create designs maybe discontinued e.g. a particular colour ribbon. This is out of the control of Dovey Cake Design. Suitable replacement products will be sourced. In all cases Dovey Cake Design will try to contact the client to advise of any changes. However, Dovey Cake Design reserve the right to replace items with

component parts of equal or better quality without consultation.

 

In the unlikely event of the client being unhappy with the quality of the cake produced, the client must contact Dovey Cake Design within 24 hours and return at least 75% of the cake for us within two days in order for us to investigate and consider a refund. No refund will be issued if the cake is not returned or has been eaten.  

4. Delivery and Collection

All orders may be collected by the client free of charge from Dovey Cake Design by prior arrangement. A signature is required on collection confirming the order is received in good condition and as specified. The client will receive a wedding cake information sheet with details pertaining to the recommended storage of the cake and details of non-edible items.

 

When delivering to a wedding venue, Dovey Cake Design will contact the venue directly in advance to arrange a mutually convenient time for delivery. If Dovey Cake Design set up the wedding cake in situ, a photograph will be taken of the cake before leaving. Where possible, a signature will be obtained from the venue, confirming the wedding cake has been received in good condition.

Should the venue be responsible for setting up of the wedding cake, Dovey Cake Design shall explain how this is to be done.

Once a cake has been delivered, Dovey Cake Design are unable to accept liability for any damage sustained to the cake thereafter.

5. Price and Payment

A £100 non-refundable deposit is required to secure the client’s chosen delivery/collection date.

 

The full price of the wedding cake will be set out in the Confirmation of Order.

 

The total cost detailed on the Confirmation of order is payable 28 days in advance of the wedding.

An invoice will be issued detailing the received deposits, balance and payment details.The balance must be paid in cleared funds no later than the date set out in the Confirmation of Order by bank transfer to the account specified. If payment is not received, Dovey Cake Design reserves the right to withhold an order until payment is made in full. When payment is late, Dovey Cake Design accepts no responsibility should the availability of stock or equipment required to produce the wedding cake be impacted by the delay.

 

No VAT is payable on Dovey Cake Design products.

6. Hiring of Additional Items

If additional items are being hired from Dovey Cake Design such as stands, bases and separators, a security deposit is required. All additional items hired from Dovey Cake Design are to be returned within 5 days of the wedding date. If the client is unable to return the item(s) within this time scale a designated person must do so on their behalf.

If the stand is not returned within 5 days of the wedding, the deposit will not be returned.

If the stand is returned damaged, the deposit will not be returned.

Payment will be deemed as acceptance of these terms. 

7. Food Safety

Dovey Cake Design cakes and dessert tables are made in an environment where nuts and gluten are present; we cannot guarantee that any cake is entirely nut or gluten free.

Dovey Cake Designs cannot accept any responsibility for any injury caused by the presence of any specific dietary allergens. It is the responsibility of the client to inform their guests of any allergens which could be present in the wedding cake. All items will be supplied with full allergen information detailed in documentation, in writing both before the wedding and on the day of. 

 

If the wedding cake contains decorative elements made from sugar paste or wafer paper, whilst edible, Dovey Cake Design do not advise that they be consumed. This is due to the possible presence of dowels and wires for reinforcement. The Client will be advised by Dovey Cake Design when this is the case.

The wedding cake is a fresh product containing no additives or preservatives and it is the right of Dovey Cake Design to assume consumption on the day of the event as detailed in the Confirmation of Order.

 

Fondant wedding cakes should be stored in a dry place, at room temperature, away from direct sunlight, sources of heat and in the box provided. They should not be stored in a fridge, which will damage the product.

Buttercream cakes may be stored in a fridge. Dovey Cake Design will advise as to whether this is apporpriate. 

 

Please see the cake information sheet provided with the order for any extra storage requirements.

When using fresh flowers to decorate your cake, please note that some flowers and foliage are not suitable for use as a cake decoration.  Ask your florist for details and advice on the toxicity as we cannot be liable for any contamination to your wedding cakes that may arise from their use/misuse.

8. General Terms

All designs remain the property of Dovey Cake Design. Any samples, drawings or designs issued by Dovey Cake Design, including those on websites or social media profiles are issued solely to provide anapproximate illustration of the cake they describe.

 

Dovey Cake Design reserve the right to use images of the wedding cake for any form of advertising, PR, press activity, web based promotion, brochures, galleries and competitions.

 

Terms and conditions may change at any time but will not affect the client’s

contract with Dovey Cake Design. This does not affect the client’s statutory

rights.
